You must read these Official Rules before entering the 2010 Workday Rising Video Contest (the “Promotion”). Submission of an entry in the Promotion constitutes full and unconditional agreement to be bound by these Official Rules.
NO PURCHASE NECESSARY. The Promotion is void where any aspect of the Promotion is prohibited by law. This is a skill based contest. Chance plays no part in the selection of the winner.
Between 12:01 a.m. Pacific time on August 9, 2010 and 11:59 p.m. Pacific time on October 1, 2010 (the “Promotion Period”), post a qualifying video on www.youtube.com and email the link to your video to contest@workday.com. No entries before or after these dates will be accepted. In your email, state your name, your current employer′s name and where you have had experience with Workday. To qualify, all videos must be no more than one minute long and must describe how Workday has revolutionized your day-to-day working experience. No screen images from Workday or confidential information of any party may be included. Entries must be in English and accurately reflect the entrant′s experience. In the Sponsor′s sole discretion, entries may be disqualified if they include any inappropriate content. Entries must be original and entrant must have all of the rights necessary to post the video and submit the entry, including, if applicable, permission from entrant′s employer, all individuals appearing in the video, and the owners of any copyrighted material used.
The Sponsor of the Promotion is Workday, Inc., 6230 Stoneridge Mall Road, Pleasanton, California 94588, USA. All questions regarding the Promotion should be directed to contest@workday.com.
Employees, independent contractors, officers and directors of Sponsor are not eligible to win nor are their immediate family members (spouse, parents, siblings, and children). Entrants must be at least the age of majority in his or her jurisdiction of residence during the Promotion Period.
Entries must meet all rules and submission criteria as stated herein to be eligible. Entries will be evaluated by a panel of judges. Videos will be judged on content, creativity and the uniqueness of the entrant′s idea.
The Grand Prize winner will receive a Flip MinoHD™ and, if staying at the hotel selected by Sponsor while attending the 2010 Workday Rising conference, a hotel room upgrade to a “One Bedroom Suite” for up to 3 nights (approximate retail value $1350.00). Four 1st Prize winners will each receive a Flip MinoHD™ (approximate retail value of $230.00). Winners will be announced on the workdayrising.com web site homepage on October 6, 2010. Sponsor will also attempt to contact the winners by email through the email address used to make the entry. If the Grand Prize winner will not be attending the Workday Rising conference or will not be staying at the hotel selected by the Sponsor for the conference, the suite upgrade will be forfeited. The Grand Prize winner is responsible for paying the standard room rate for his/her hotel room and all other taxes and charges. Workday is not responsible for transportation to the conference or for any expenses related to attendance. Winners will receive their Flip MinoHD™ upon arrival at the Workday Rising conference or, if not attending, by mail. Prizes cannot be redeemed for cash. Sponsor makes no warranties with regard to any prize. The color and exact specifications of prizes will be determined by Sponsor in its sole and absolute discretion. Winners are solely responsible for all applicable taxes, fees and surcharges associated with prize receipt and/or use. Winners may be required to provide Sponsor with a signed declaration of eligibility and compliance with these Official Rules as well as evidence that the winner′s employer has consented to the use of its name and other company information.
By entering the contest, all parties fully and unconditionally agree to and accept the rules as outlined herein and agree to accept the decisions of Sponsor and the contest judges which are final and binding. By entering the contest, entrant irrevocably grants to Sponsor the right to display, copy, make derivative works, distribute and otherwise use any and all submitted videos as it sees fit without any fee or other form of compensation. Without limiting the foregoing, entrants expressly consent to Sponsor posting all entries to the workdayrising.com web site, the Workday Community, the workday.com web site and/or to include links to the video on www.youtube.com from such sites. You may delete your video after Monday, October 11, 2010 but Sponsor has the right to keep and post a copy of the video indefinitely. Each entrant warrants that its entry submission does not contain confidential information of any party and that the submission does not violate or infringe upon any third party rights, or violate any laws or regulations.
Proof of submission will not be deemed to be proof of receipt by Sponsor. Sponsor reserves the right to cancel, suspend and/or modify the Promotion, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Sponsor reserves the right to reject any entry for any reason. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
By participating in the Promotion or accepting any prize, winner agrees to release and hold harmless Sponsor and its subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies and each such company′s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion or receipt or use or misuse of any prize or participation in any Promotion-related activity and for any claims based on publicity rights, defamation or invasion of privacy and merchandise delivery.
THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (1) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY ENTRANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE PROMOTION; (2) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, TRAFFIC CONGESTION OR DISCONNECTIONS IN PHONE OR INTERNET LINES OR NETWORK HARDWARE OR SOFTWARE; (3) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE ENTRY PROCESS OR THE PROMOTION; (4) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE PROMOTION OR THE PROCESSING OF ENTRIES; OR (5) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM ENTRANT′S PARTICIPATION IN THE PROMOTION OR RECEIPT OR USE OR MISUSE OF ANY PRIZE INCLUDING ANY INJURY OR DAMAGE TO ENTRANT′S OR ANY OTHER PERSON′S COMPUTER RELATED TO OR RESULTING FROM PARTICIPATION OR DOWNLOADING ANY MATERIALS IN THE PROMOTION.
Any personal information received by Sponsor in connection with this Promotion will be used solely in accordance with Sponsor′s privacy policy, which can be found at http://www.workday.com/company/privacy.php.
When creating an account and posting a video to video sharing sites like Youtube.com and Vimeo.com, you’re subject to their privacy policy as well.
These Rules and this Promotion are governed by and controlled by the laws of the State of California, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within the State of California, Alameda County. The parties consent to the jurisdiction of the state courts of California and the federal courts located with such state and county with respect to any action, dispute or other matter pertaining to or arising out of this Promotion. This Promotion is subject to all applicable laws. Void where prohibited.
Submission of an entry in the contest constitutes consent for Workday to use the names of entrants, along with their employer′s name, in any media without further consideration. Winners agree to allow Sponsor to use his or her name, photograph, likeness, voice, prize information, and biographical information for publicity and promotional purposes without further compensation where permitted by law.
The names of the winners will be listed online at www.workdayrising.com within approximately ten (10) days following the end of the Promotion Period. Individuals may request the names of the winners by submitting a self-addressed, stamped envelope before November 24, 2010 to Workday, Inc., 6230 Stoneridge Mall Road, Pleasanton, CA 94588, attention: 2010 Workday Rising Video Contest.
